On this page, you will find data protection notices/information (pursuant to Art. 13 GDPR) on the collection and processing of personal data within the scope of the Research Data Management consultation service.

General Information on Data Processing

Subject Matter and Purpose of Processing Personal Data

Provision, administration, and use of the Adobe licenses and the associated products (Acrobat Pro DC, Creative Cloud All Apps Pro for Faculty/Staff (Named User License), Creative Cloud All Apps (Shared Device License)) for the performance of official duties at RWTH (Research, Teaching, Administration), including verification of usage authorization and support.

    Furthermore, users can access online services via the Adobe web interface. The login for license use and use of online services is done via the RWTH Single Sign-On. The following data is transmitted in this process:

    • User's email address
    • User's first and last name
     

    Recipients of the Data

    Internal recipients: IT Center for license administration/support).

    RWTH transmits the personal data mentioned above via the RWTH Single Sign-On service to Adobe Systems Software Ireland Limited as a processor, as well as to the subprocessors engaged by Adobe (e.g., hosting/support), in accordance with contractual agreements (DPA) and EU standard contractual clauses (SCC) for third-country transfers.

     

    Legal Basis for the Processing of Personal Data

    The processing of personal data in connection with the provision and use of the Adobe licenses mentioned above takes place within the scope of the University's mandate fulfillment (Research, Teaching, Administration).
    The legal basis is Art. 6 Para. 1 Sentence 1 lit. e), Para. 3 in conjunction with § 18 Para. 1 DSG NRW in conjunction with § 3 Para. 1 HG NRW.

     

    Data Deletion and Storage Duration

    To use the license, an account is set up with Adobe for the user. User data at Adobe will be deleted 30 days after the deletion of the relevant account or after contract termination.

     

    Provision of Adobe Online Services and Creation of Logfiles

    Subject Matter and Purpose of Processing Personal Data

    Each time the Adobe Online Services are accessed, an exchange of information between your end device, such as your computer, tablet, or mobile phone, and servers that provide the website for retrieval is technically necessary to establish communication between your end device and this application. With every access, data about this process is also temporarily processed and stored in a logfile. Specifically, the following data is collected:

    * Date of the action
    * Name of the user
    * Email address of the user
    * Path
    * Information on documents used (e.g., type and name of the document, creation date, last editing date)
    * Information about the user's end device (e.g., IP address)

    The log data is processed for the proper operation of the websites, i.e., for detecting, limiting, or eliminating faults or errors.

    In addition, the log data is processed for technical security, particularly for protection against and defense against cyberattacks. This is done on the basis of Art. 6 Para. 1 Sentence 1 lit. e), 32 Para. 1 GDPR.

    Legal Basis for the Processing of Personal Data

    The temporary storage of data for technical communication and the logfiles is carried out on the basis of Art. 6 Para. 1 Sentence 1 lit. e), Para. 3, in conjunction with § 18 Para. 1 DSG NRW in conjunction with § 3 Para. 1 HG NRW.

    Data Deletion and Storage Duration

    In the event of termination of the contract or upon expiration of the license term of the products and services, customer data and content stored in the On-Demand Services will be kept available in the format available on the Report Platform for a period of 30 days after termination or expiration.

    Furthermore, for On-Demand Services, Adobe is entitled to delete customer data from Adobe servers 25 months after receiving it, unless otherwise regulated in the applicable product-specific license terms.

    Rights of the Data Subject

    If personal data of the data subject is processed, he/she has the following rights against the controller.

    Pursuant to Article 15 et seq. GDPR, the data subject has the right against the controller, under the conditions defined therein, to obtain information about the personal data concerned, as well as the right to rectification or erasure or restriction of processing, a right to object to the processing, and the right to data portability. Furthermore, pursuant to Article 77 GDPR, he/she has the right to lodge a complaint with the data protection supervisory authority (https://www.ldi.nrw.de/) if the data subject considers that the processing of personal data concerning him/her infringes this Regulation. If the processing is based on the data subject's consent (cf. Art. 6 Para. 1 lit. a, Art. 9 Para. 2 lit. a GDPR), he/she also has the right to withdraw the consent at any time, without affecting the lawfulness of the processing carried out on the basis of the consent until the withdrawal; this only takes effect for the future.
