3. General information on data processing

a)    Scope and purpose of the processing of personal dat

SoSci Survey enables individually customized online surveys with the integration of images, audio, and video.
For surveys that collect personal data, as well as for collaborations with companies, commercial licenses are available and can be purchased by RWTH institutions through the software shop.
To obtain a commercial license, a user account must be set up in advance and linked to the campus license; authentication for using the commercial license is carried out via RWTH single sign-on. In this process, the following data are transmitted:

• Email address
• Affiliation and status at RWTH

b)    Data recipients

Internal recipients: IT Center for licence management/support.
RWTH transmits the above mentioned personal data via RWTH Single Sign-on to SoSci Survey as commissioning party.

c) Legal basis for the processing of personal data

The processing of personal data in connection with the provision and use of the above-mentioned SoSciSurvey commercial licenses is carried out as part of the university’s performance of its tasks (research, teaching, and administration).
The legal basis is Article 6(1), first sentence, letter (e), and paragraph (3), in conjunction with Section 18(1) of the North Rhine–Westphalia Data Protection Act (DSG NRW) in conjunction with Section 3(1) of the Higher Education Act of North Rhine–Westphalia (HG NRW).

d) Data deletion and retention period

Security copies (backups) created to protect against data loss are retained for 12 months and then deleted.
Deletion of the user account is carried out independently by the users.

4. Rights of the data subject

If personal data relating to the data subject are processed, the data subject has the following rights vis-à-vis the controller.
Pursuant to Articles 15 et seq. of the GDPR, and subject to the conditions defined therein, the data subject has the right to obtain information about the personal data concerned, as well as the right to rectification or erasure, or restriction of processing, the right to object to processing, and the right to data portability.
In addition, pursuant to Article 77 of the GDPR, the data subject has the right to lodge a complaint with the competent data protection supervisory authority (https://www.ldi.nrw.de/kontakt) if the data subject believes that the processing of personal data relating to him or her violates this Regulation.
Where processing is based on the data subject’s consent (cf. Article 6(1), first sentence, letter (a), and Article 9(2), letter (a) GDPR), the data subject also has the right to withdraw consent at any time. This does not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal; the withdrawal takes effect only for the future.
