Adobe ETLA Terms of Use

Preamble
Adobe now only offers most of its software products as rental licenses with management in the cloud. Various products available there (Acrobat, Photoshop, Illustrator, etc.) are offered to members of RWTH Aachen University. Licensing is based on the Adobe ETLA contract. Generally, usage is through a local installation and licensing in the cloud. Data storage in the cloud is technically possible andsubject to organizational regulations.Prerequisites for usage and costs
Adobe licenses may only be used for official purposes and projects. In accordance with the license agreement, the use of Adobe products is not permitted in Russia, Belarus, or China.
Individual services may also be subject to the Adobe Privacy Policy. In addition, the Product Terms published by Adobe apply. We explicitly point out that these are binding and must be observed.
Employees and students of RWTH Aachen can obtain the various Adobe products through the RWTH Aachen Software Shop.
The products “Adobe Acrobat Pro DC” and “Adobe Creative Cloud All Apps Pro” can be purchased for a fee. The product “Adobe Acrobat Reader” is provided free of charge.
Authentication for license allocation takes place via the Single Sign-On service (Shibboleth) of RWTH Aachen.
Duties of the Users
- The use of Adobe software and services is carried out in accordance with the respective current version of the Privacy Policy.
- The use of Adobe is intended for activities in the context of RWTH Aachen and exclusively for official duties. Accordingly, use for private purposes is not permitted.
- When using Adobe, the valid legal provisions and regulations (license law, data protection law, personnel file law, tax law, copyright law, telemedia law, statutory retention periods, archive law, US export control law, and others) must be complied with.
- There is only authorization to use the software and services during the licensed period and with an appropriate status (employee or student). All software must be deleted or services must no longer be used if RWTH Aachen terminates the contract or does not submit an accession or renewal order before the licensed period expires, or does not acquire perpetual licenses, whichever event occurs first.
- Before employees or students leave RWTH, they are responsible for deleting all data, including the account, in Adobe.
- No personal or confidential data, or sensitive research data, may be processed or stored in the Adobe Cloud or in the AI functions.
Recommendation for Use (Best practices)
- In principle, it is possible to store data in the Adobe Cloud, as no central technical restrictions can be made here. Furthermore, AI tools or functions are provided in some Adobe services. Since using the Adobe Cloud and the AI functions means the data leaves the university area and can be processed or stored externally, we recommend not using these functions.
Should these be used contrary to the recommendation, the user is responsible for securing the stored data. - Therefore, please check the necessity every time you save to the cloud.
Data Protection
In addition, we refer to the RWTH Aachen data protection information regarding Adobe as well as to the Adobe data protection information.
Changes to the Terms of Use
- The IT Center of RWTH Aachen reserves the right to change these Terms of Use at any time, with or without prior notice.
- Users will be informed immediately of significant changes to the Terms of Use. This information can be provided by email or by publication on the website of the RWTH Aachen IT Center.
- As of the effective date, the respective valid version of the Terms of Use can be accessed on the website of the RWTH Aachen IT Center and replaces all previous versions. All users should regularly inform themselves about changes.
Final Provisions
- Should one or more provisions of these Terms of Use be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The contracting parties shall endeavor to find a valid provision in place of the invalid one that comes closest to the economic meaning of the invalid provision.
- Changes and additions to these Terms of Use require written form, unless expressly agreed otherwise. There are no verbal subsidiary agreements.
